JUDGE PHYLLIS J. HAMILTON OF THE UNITED STATES DISTRICT COURT FOR THE NORTHERN DISTRICT OF CALIFORNIA

          TO ALL CIVIL LITIGANTS WITH MATTERS CURRENTLY PENDING BEFORE THE HONORABLE PHYLLIS J. HAMILTON:

         

          In light of the current public health emergency caused by coronavirus disease (COVID-19), the court issues the following Notice with the aim of balancing public health and safety concerns, including minimizing the risk of exposure, with the need for scheduling certainty and having civil matters proceed regularly.

 

         

         1.       All Case Management Conferences shall be held telephonically through CourtCall, unless another conference line is noted on the case docket.  No requests for telephonic appearance are required for CMCs during the effective period of this Notice.  The parties shall refer to Judge Hamilton’s Notice re CMC Telephonic Appearance Procedures for using CourtCall services.

 

          2.       All Law and Motion matters will be submitted on the papers.  No oral argument or personal appearance shall be held on regularly noticed or specially set motion hearings or other matters in civil cases.  Any hearing set on the Court’s calendar in a civil case during the effective period of this Notice shall be vacated.  Civil motions will be decided on the papers.

 

          3.       All Civil Trials are subject to continuance.  If the court determines that continuance of a trial is warranted by ongoing public health concerns, a notice of continuance will be issued.

 

          This Notice remains in effect until June 1, 2020, and may be extended by the court.  All matters before the court are governed by General Order No. 72.

          In light of concerns about the current public health emergency caused by coronavirus disease (COVID-19), the court issues the following Notice for scheduling criminal matters on the court’s calendar.  Judge Hamilton’s criminal calendar will continue to be called on a regular basis.  However, defense counsel may request postponement or waiver of appearance with the defendant’s consent.  Counsel may direct any questions or requests for other accommodations to Judge Hamilton’s Courtroom Deputy, Kelly Collins.

 

Civil Law and Motion: Wednesday @ 9:00 a.m. (No tentative rulings are issued and no hearing date needs to be reserved.  Telephonic appearances for motions are not permitted)
Case Management Conferences: Thursday @ 2:00 p.m. once per month (See list below for dates) (Telephonic appearances by CourtCall will be permitted upon request for leave to appear by phone filed no later than 7 days in advance of the conference, except for counsel located within the Bay Area, patent cases, cases with numerous parties and attorneys, and matters as determined by the Court. Criminal Law and Motion and Pretrial Conferences: Wednesday @ 1:30 p.m. for in custody matters at 2:30 p.m. for out of custody matters

Trials: Monday, Tuesday, Thursday and Friday, 8:30 a.m. - 1:30 p.m.

Commencing June 1, 2020 until further notice:

Civil Law and Motion: All motions will be decided on the papers. All parties may continue to file motions and may continue to notice them for hearing. However, no oral argument or personal appearance will be held on noticed civil matters unless the Court determines, after review of the papers, that a hearing is necessary. If the Court determines that a hearing is necessary, the hearing will be conducted via telephone or Zoom webinar.  Such remote hearing will generally be held on the 2nd and 4th Wednesday of the month at 9:00 a.m. The noticed date is simply the placeholder date and will not necessarily be the date of the hearing. Instead, counsel will be notified of the specific date and method of hearing.

Case Management Conferences: Thursday at 2:00 p.m., once per month via telephone or Zoom webinar. (See list below for available dates)

Civil Pretrial Conferences: Thursday at 2:00 p.m., via telephone or Zoom webinar.

Trials: Monday, Tuesday, Thursday and Friday, 8:30 a.m. - 1:30 p.m.

Criminal Law and Motion: 1st and 3rd Wednesday at 9:00 a.m. for personal in-court appearances of both in-custody and out of custody defendants for Change of Plea, Sentencing, Admission/Disposition of Form 12s, and Evidentiary Hearings or at 2:00 p.m. via telephone with waiver of defendant's personal appearance.

CERTIFICATE OF UNAVAILABILITY:

This is to certify that The Honorable PHYLLIS J. HAMILTON will not be available:

September 16, 2020 through and including September 18, 2020

 

All counsel are hereby given notice that court will not be in session during this period, and such absence constitutes a Certificate of Unavailability as provided in Civil Local Rule 1-5(p).  If urgency requires, counsel in any case assigned to Judge Hamilton, may request a hearing before the General Duty Judge as provided in Civil Local Rule 7-1(c).

CHAMBERS COPIES OF E-FILED DOCUMENTS
In all "E-Filing" cases, in addition to filing papers electronically, the parties are required to lodge a courtesy paper copy of each document no later than noon on the day following the day that the papers are filed electronically.  These copies shall be marked "Chambers" or "Courtesy" copy and shall be submitted to the Clerk's Office, in an envelope clearly marked with Judge Hamilton's name.
