COVID19 SPECIAL PROCEDURES IN PLACE UNTIL ORDERED OTHERWISE

The Court’s general practice in civil cases is to (1) handle case management issues in an order based on the parties’ Joint Case Management Statement and to continue case management conferences, and (2) to decide law and motion matters on the parties’ filings without a hearing.  In light of Covid19, when the Court holds a civil case management conference, those case management conferences will be held by telephone or videoconference.  Similarly, when the Court holds a hearing on any motion, those hearings will be held by telephone or videoconference unless the parties request otherwise.  During this time, parties need not file motions to appear by telephone.  For telephonic or videoconference proceedings, the Court will post the information on how the public and press may participate on the case dockets and the Court’s public calendar. 

As to criminal cases, if the parties wish to have in-person court proceedings, these proceedings will take place in Courtroom 8, Floor 4 in the San Jose Courthouse.  If the parties request it, and the Court can make the appropriate findings, the Court will hold criminal court proceedings, including sentencings, change of plea hearings, and supervised release violation hearings, by telephone or videoconference.  For telephonic or videoconference proceedings, the Court will post the information on how the public and press may participate on the case dockets and the Court’s public calendar.  Any stipulations to continue criminal proceedings should identify (1) the reason for the continuance, (2) when the parties would like to schedule the next court date, and (3) in pre-trial cases, any basis to exclude Speedy Trial time.

The Court does not require chambers copies in civil or criminal cases at this time.   

 

COURT SCHEDULE:
Trials will be held 9 A.M.-4:30 P.M. on Mondays, Tuesdays and Fridays.

Criminal Calendar: Wednesdays at 9:15 A.M. 
Parties seeking a hearing date or a continuance via stipulation or proposal must clear any new dates with the Court's calendar. To do so, all parties shall email LHKCRD@cand.uscourts.gov, prior to the submission of their filing.   All emails must include representatives from ALL parties.

Civil Case Management Conferences: Wednesdays at 2 P.M.

Civil Law and Motion and PreTrial Conferences: Thursdays at 1:30 P.M. 
To obtain a motion hearing date, please EMAIL LHKCRD@cand.uscourts.gov. Parties must file their notice of motion, motion, memorandum of points and authorities, and proposed order the same day that the parties obtain a hearing date or the next business day. Otherwise, parties must obtain a new hearing date.  All emails to the CRD must include representatives from ALL parties.

TELEPHONIC APPEARANCES:
The parties are directed to file and serve their motion and proposed order seven (7) days prior to the scheduled Court date.  If the request is granted, the parties are directed to contact CourtCall Remote Court Appearances at (866) 582-6878, in advance of the hearing, to finalize their appearance.  The parties are to adhere to CourtCall’s procedures.

Motions to Appear by Telephone should filed under Civil Events --> Motion and Related Filings --> Motions - General --> Appear by Telephone.

EX PARTE COMMUNICATIONS:
When contacting the Court, all parties shall abide by Civil Local Rule 11-4(c). Communications made in violation of the local rules will be disregarded as such.

CERTIFICATE OF JUDGE'S UNAVAILABILITY:
None at this time.

CHAMBERS COPIES: All printed chambers copies must be double sided and must include the ECF header on each page. 
All cases subject to E-filing requirements must submit a Chambers copy of all documents and electronically file all proposed orders.   A printed chambers copy of any electronically filed document must be lodged with the Court the next court day following the day the documents were electronically filed.  All proposed order should be emailed in Microsoft Word format to: lhkpo@cand.uscourts.gov the same day.
