All civil motions, except for motions for preliminary or final approval of class action settlements or motions for default judgment, must be noticed for in-person hearing on Thursdays at 10:00 a.m. 

Absent extraordinary circumstances, the Court will not hold hybrid hearings (with some counsel appearing in person and some remotely). Parties may file a joint stipulation or an administrative motion requesting that the Court convert an in-person hearing to Zoom and set it for the 2:00PM calendar. Such requests should be filed by the Monday before the hearing. The Court may deny the request if it believes an in-person hearing would be more beneficial.

The Court may, on its own accord, issue a clerk’s notice converting and rescheduling an in-person hearing to the 2:00 p.m. Zoom calendar. Counsel is responsible for knowing whether the hearing is in person or over Zoom and should check the docket in preparation for the hearing.

Members of the public can listen to audio of all civil in-person hearings through the Zoom link on Judge Chhabria’s webpage.

Civil motions being heard over Zoom take place Thursdays at 2:00 p.m. Motions for preliminary or final approval of class action settlements and motions for default judgment must be noticed for this Zoom calendar. As discussed in the previous section, some other motions that are normally heard in person may be moved to the Zoom calendar.

Members of the public can view these hearings through the Zoom link on Judge Chhabria’s webpage.

Typically, Zoom audio access to in-person criminal proceedings will not be provided; interested members of the public can observe proceedings in the courtroom. In special circumstances and with advance agreement by the government and the defendant to waive any Rule 53 objections, the Court will consider providing remote audio access to an in-person criminal proceeding.

For any proceedings other than the ones described above (for example, subsequent status conferences, scheduling conferences, or trial settings), the attorneys and the defendant will appear by Zoom, so long as both sides consent and agree on the record to waive any Rule 53 objections.
